While the complete book on Codes and Ordinances of the City are available through a link provided on this and other pages throughout the web site, there are some ordinances which have either been recently passed or changed, or which draw a great deal of interest. This section will attempt to provide easily-accessible information on some of those.
Curfew for Minors
Sec. 16-21. Curfew for minors; exceptions.
(a) No person under 18 years of age shall idle, play, stroll, or wander about, in or upon the:
(1) Alleys, roadways, streets;
(2) Parks, play grounds, or other public grounds;
(3) Places of amusement or entertainment;
(4) Public places or buildings;
(5) Unoccupied residences or buildings;
(6) Vacant lots;
(7) Common areas of apartment complexes; or
(8) Other unsupervised places;
within the limits of the city between the hours of 11:00 p.m. and 6:00 a.m. on Sunday through Thursday, and between the hours of midnight and 6:00 a.m. on Friday and Saturday.
(b) Those persons under 18 years of age excepted from the above provisions shall be those who are:
(1) Accompanied by his or her parents, guardians or other adult person having the care and custody of said minor;
(2) Engaged upon an emergency errand;
(3) Engaged in the performance of their employment duties;
(4) Traveling directly to or from his or her place of employment and residence;
(5) Upon legitimate business as directed by his or her parents, guardians or other adult person having the care and custody of said minor;
(6) In a motor vehicle involved in interstate travel;
(7) Attending an official school, religious or other recreation activity which is supervised by adults and sponsored by the City of Broken Arrow, a public or private school, a civic organization, or another similar entity that takes responsibility for the minor;
(8) Returning home without any detour or stop from an official school, religious, or other recreational activity supervised by adults and sponsored by the City of Broken Arrow, a public or private school, a civic organization, or another similar entity that takes responsibility for the minor; or
(9) Exercising first amendment rights protected by the constitution, such as the free exercise of religion, freedom of speech and the right of assembly.
(c) It shall be unlawful for the parent, guardian or other adult person having custody or control of any minor under the age of 18 to permit, or by inefficient control to allow, such person to be on the streets or sidewalks or in any other public place within the city in violation of section 16-21(a) of this Code; provided that the parent or guardian shall be excepted from the provisions if a missing persons report on the child has been made to the police department.
(d) Violation of this section (c) shall be a class A offense.
